OptiTax organises the evidence behind a tax return and puts it in front of a registered practitioner. It does not file, it does not advise, and it does not pretend to know a number it has not been given. These are the terms that follow from that.

// 1. WHAT THE SERVICE IS

A working file, not a filing button

OptiTax reads slips, statements, tax certificates and other documents you send, sorts them against a return, matches spending to evidence and shows what is missing. It computes a position from the evidence in front of it. That position is a working figure for the review, and it changes as evidence arrives.

OptiTax is a trade mark used by Kerry Gunning t/a Green Kow. Using the site or an account means you accept these terms.


// 2. WHO FILES, AND WHO ADVISES

A REGISTERED PRACTITIONERSUBMITS. NOT US.

Section 240 of the Tax Administration Act requires anyone who prepares a return for reward to be registered with SARS and to belong to a recognised controlling body. So a practitioner reviews the return, signs it off and submits it with their name on it. OptiTax has no SARS credentials and submits nothing. What the engine produces is an estimate and an organised file, and neither is tax advice.

The documents you send are yours, are genuine, and are complete for the period being worked on. We read them, keep them against your return and show you what we made of each one.
A claim is a real business or deductible expense, and you can stand behind it if SARS asks. Every claim is named against the section it rests on, so you can see what it is being claimed under.
You check the return before it is signed off, and you tell your practitioner what the engine could not have known. We name the gaps rather than filling them in with an assumption.
Your login is yours. You do not share it, and you tell us if it is compromised. We log sign in attempts and keep an audit line for who opened what and when.

If a document is not sent, the amount on it does not exist as far as the engine is concerned. Nothing is estimated into a gap to make a total look complete.


// 4. WHAT IT DOES NOT DO

It does not read sales

There is no sales ledger in the application. Everything that would sit on top of revenue is shown as an absence with the reason, not as a number.

It does not touch your bank

No bank login, no bank connection. Bank lines come from statements you send.

It does not submit

No return, no supporting document and no correction goes to SARS from this application.

It does not advise

Reading a rule back to you is not the same as telling you what to do about your situation. That conversation is with your practitioner.


// 5. ACCOUNTS AND BILLING

Per month, cancel any time

Every plan and every price sits on one page and is not repeated anywhere else, so there is no second version to disagree with it. The prices are here. Everything is per month and in rand.

Payments run through PayFast. Card details are entered on PayFast's own pages and never reach OptiTax, so there is no card number in this application to lose.

Ask, and the subscription is cancelled. The month you have already paid for runs to its end and nothing further is taken. Cancelling stops the billing; it does not delete your file, because your practitioner may still have retention obligations against it. If you want the file deleted as well, the privacy page says what can and cannot go.

Yes, for a payment that has failed and stayed failed, or for the things in the next section. We would tell you why, and you would get your documents back.


// 6. USING IT PROPERLY

Four things that end an account

Sending documents that are not yours, or that have been alteredThe whole point of the file is that a claim can point at real evidence. A forged slip makes the practitioner's sign off worthless and puts their registration at risk.
Using somebody else's login, or sharing yoursThe audit trail has to mean something. "Who opened my file" needs one name in the answer.
Probing, scraping or overloading the serviceOther people's tax files are on the same system.
Reselling or white labelling without an agreementThere is a white label arrangement and it is a conversation, not a copy and paste. It is set out here.

// 7. AVAILABILITY, AND WHAT WE ARE ON THE HOOK FOR

Honest about the ceiling, rather than silent about it

The service is provided as it stands. We work to keep it up and we do not promise it will never be down. Maintenance happens, and a third party the engine depends on can have a bad day, in which case a document read may be slower or may have to be retried.

OptiTax is not liable for a penalty, an interest charge, an assessment or a loss that follows from evidence that was not sent, evidence that was wrong, or a decision taken without your practitioner. Where liability cannot be excluded by law, it is limited to what you have paid for the service in the twelve months before the claim. Nothing here limits liability for fraud or for anything else the law does not allow to be limited.

These terms are governed by South African law, and the courts of South Africa have jurisdiction. If we change them, the date at the top of this page changes and the current version is always the one on this page.
